Hamas re Israel
On October 7, 2023, Hamas breached Israel's southern border, coordinating the deadliest terrorist attack on Israeli civilians and against Jews since the Holocaust. Hamas murdered 1,200 individuals, targeting music festivals, kibbutzim (civilian communities), children, and the elderly. Over 250 individuals were violently taken hostage into Gaza, paraded around, assaulted, and placed in inhuman conditions; some hostages were murdered in captivity. CEO of the International Legal Forum Michal Cotler-Wunsh explains, “As details of Hamas’ terrorist attacks become more apparent, our shock at their barbarism only grows. The brutal massacres, rape, looting, and kidnapping perpetrated by Hamas have no justification or legitimacy and must be universally condemned. There is never any justification for terrorism.” Hamas militants had the requisite knowledge of the attack, which is an essential element of Article 7, Crimes Against Humanity. Evidence demonstrates that, “Hamas used detailed maps of Israeli communities near the Gaza border … to plan its attacks on 7 October.” Hamas should be held responsible for breaches that fall under Rome Statute Art. 7, including the crimes against humanity of murder, torture, extermination, rape and other forms of sexual violence directed at civilians on October 7, 2023.
